Help re: distance selling please! (off topic)
Hi guys, I need your knowledge please.
I purchased a car part, which was not right for my car, basically, I sent it back unopened. But they only refunded me £50 when the whole thing including delivery cost £68 I even had to pay for return postage. Is this company violating any distance selling law? They only operate by post. x

Have you looked at their terms and conditions ?
From experience ,I can say that firms selling car parts have very stringent return policies (-with good reason,as customers often try to take the &^%$ and use the parts or replace the new parts with old parts and then try to claim a refund).Their return policies in no way compare with,eg,M & S ! Generally,car parts cos will only grant full refunds ,including payment for your return postage if > 1/the part which has been sent to you has been incorrectly supplied (ie,they've given you something other than that which you ordered) If however as you suggest,you made the mistake in ordering the incorrect part,it is common practice for them to grant you a partial refund (ie,they'll do you the favour of taking back the part,provided said part is unused ;ie,not covered in grease;or used ) but they will make you pay the cost for the return postage. Most importantly,if they do offer to take the part back ,as well as making you pay for the cost of postage,they will also charge you a handling fee. This may be as much as 10% > 15%. The above is standard practice. If,as you say,you purchased this online,they must have the T&C on show somewhere which you can check as,eg,Worldpay stipulate that you have to have some form of returns policy in place. Ken, the company is A&C autosalvage And I haven't got access to their terms on conditions. Thing is, they SAY I asked for a 1.0 litre, well, excuse me, i'm not an idiot and I know my car is 1.3 everyone else rang with quotes for the right part, therefore I didn't feel the need to verify it with them KWIM? xx

Ken -- they operate by phone only.
The manager keeps fobbing me off. Today I asked them to fax me a copy of how much it cost to ship A copy of their terms and conditions and proof that the information which came through stated the wrong car part. I was told to call back tomorrow! GRRRRRRRRRRRRRRRRRRR!!!!!!

I contacted trading standards who told me to stop the phone calls, to simply write them a letter stating that if my money was not refunded in 14 days i'd sue them in the county court!
I've also got proof now that they definitely got the right info via the website I submitted it to! x Thanks for you help ![]() xx
