Sadly, not really
You can post a dispute with Nominet, but they need to see proof of loss of trading income, passing off, material copyright breach, etc One of the golden rules when buying Domain Names for your business, buy all the main TLDs : .com .net .co.uk

Based in Ellon Registered 26 June 2008 northeastprint.co.uk Based in Aberdeen Registered 27 August 2008 Given the registered dates, northeastprint.com would more than likely win a copyright case, so I'd stay quiet!

Im an Elloner haha. I've bought a big range of domains print related. Does anyone know if you can have one website, with multiple domains and the content changes as per domain? I.e the site regonises the domain in the browser and shows the name of the site in the content dynamically.
if that makes sense. Kyle

Update
For the record I'm speaking to stuart at the moment, and it seems it wasn't stuart that set the site up on the domain. it was one of his staff, and stuart didnt know about it.
So we're in discussions of how we can resolve the issue. Could result in a business deal! Kyle

neither of you have TM after the name to imply that you are using the name as a Trademark and they were only registered a month apart.
i would suggest that you'll just have to buy it off him somehow as people were free to register it as you did not take up the option to buy it for £5 or whatever at the start. If you had proof that you had been using the name as a trademark for an extended period before they bought it then it may be a bit different. i don't really think there's any way that you could force him to hand it over, like most of the cases of domains being forced to be handed over take months and mostly centre around domain horders who are just holding onto the domain and holding the original owner to ransom, maybe just having adverts on their website. |
